Outside Analytics Privacy Policy

Being part of Outside Analytics, Inc. (“Outside Analytics”) and using our Services which consist of the OUTLY technology platform, means sharing information about yourself with us, with other users of our Services, communicating with others, as well as using the Site and Services on your own. This policy describes how your information is collected and used and your choices with respect to your privacy and personal information. Any capitalized terms not defined in this Privacy Policy are defined in the Outside Analytics Terms of Service.

Scope of this Privacy Policy
This Privacy Policy applies to information we collect or use on our Sites and in providing our Services including applications owned or controlled by Outside Analytics. For all other third parties, who may link to or from Outside Analytics Services, Outside Analytics is not responsible for their privacy policies or practices. Services which may be provided through affiliates or third parties having separate privacy policies that do not incorporate this Privacy Policy are excluded. Outside Analytics is further not responsible for the privacy policies or practices of third parties with whom you independently link to provide your information found on our sites or in our applications.

Information we collect

When you use the Site or the Service, you may provide us with information about you such as your name and contact information. The success of your experience with Outside Analytics necessitates the sharing of information that is personal to you so that we can provide Services that are useful and create a great experience for you. In the course of using the Site or the Service, we may require or otherwise collect information that identifies you as a specific individual and can be used to contact or identify you (“Personal Information”). Examples of Personal Information include your name, email address, billing address, phone number and or location.

We collect information in two ways:

  • Information you give us. Our Services require you to create an Outside Analytics account and when you do so, you will be required to provide us with personal information, including your name, email address, telephone number, location, gender and age range.
  • You may also choose to provide us with User Data including Personal Information, feedback, content, text, photographs, images, video, music, or other information that you post to any part of the Site or provide to Outside Analytics via the Services or any Third Party Applications.
  • Information we get from your use of our services. As you use our Site or Services, we collect other information, such as zip codes, demographic data, information regarding your use of the Services, and general project-related data (“Non-Identifying Information”). We may aggregate information collected from OUTLY or Outside Analytics registered and non-registered Users (as further defined in the Terms of Service). We consider usernames to be Non-Identifying Information. Usernames are made public through the Service and are viewable oy other Users.
  • As information about your usage, such as:
    • Device Information

      We collect information that is specific to the devices that you use to access our Services, such as your hardware model, operating system version, unique identification numbers, Bluetooth connections associated with a device, phone numbers, mobile network information, and information about app ownership and usage. These types of information may be associated with your Outside Analytics account to provide a more customized experience for you and other users.

    • Usage Information

      When you access our content and use our Services, we may collect and store information about your usage in server logs, such as:

      • details of how you used our Services,
      • your Internet protocol address,
      • device information such as crashes, system activity, hardware settings, browser type, browser language, the date and time of your request and referral URL,
      • location information including IP address, GPS, or actual location, and
      • cookies that may uniquely identify your browser or your Outside Analytics account. See our Cookies Policy here.
    • Local storage

      We may collect and store information (including personal information) locally on your device using mechanisms such as browser web storage (HTML) and application data caches.

    • Cookies and identifiers

      Outside Analytics, and its affiliates, may use various technologies to collect and store information when you visit our Site and use our Services, including the use of cookies or anonymous identifiers to your devices. See our Cookies Policy for more information.

  • Data We Receive from Others. We receive data that was initially collected (over time and across websites, mobile apps, and devices) by our business data partners (such as mobile app publishers and developers, advertising networks and exchanges and other websites and services), which includes:
    • Location and Movement Data. We receive GPS-derived location information relating to your app usage, device usage data about the places people go and visit with their mobile devices (if the mobile or other location-aware device is configured to share its location data when the device or a mobile application on the device is in use or when operating in the background). In addition to location, we receive a device identifier and other information about that device (such as the browser or device type, IP address or app publisher, operating system, carrier provider, and other similar device-specific information). We do not receive the phone number or the unique hardware device ID of a mobile device. We may identify devices using the advertising ID or a randomly assigned unique identifier (that is created through our own system).

      Data We Receive from Other Sources. We receive data and information from other data sources about places that we use to verify their location, to classify those locations (such as a government entity, or other point of interest), and to identify the location’s boundaries. We also receive other contextual data and information (such as consumer purchasing data, TV viewership, or other demographics) that can be attributed to a location or place.

Note about children. The Service is general audience and intended for users 18 and older. We do not knowingly collect Personal Information from anyone younger than age 18. If we become aware that a child younger than 18 has provided us with Personal Information, we will use commercially reasonable efforts to delete such information from our files. If you are the parent or legal guardian of a child younger than age 18 and believe that Outside Analytics has collected Personal Information from your child, please contact us at support@outsideanalytics.com.

How we use information we collect and receive

We use the information provided by you and others to create User profiles, Accounts and determine eligibility for an Account and to facilitate your experience using the Service such as when you make and store notes about a trip or activity, note your preferences.

We may use the information you provide to manage your account with Outside Analytics. When you contact Outside Analytics, we may keep a record of your communications with us. We may use your email address to inform you about our Services, such as letting you know about upcoming changes or improvements to our Services.

We use the information we collect from you to provide, maintain, protect and improve our Services. We also use this information to develop new Services and to offer you tailored content that is more relevant to your needs.

We may also provide your information to our affiliates who provide you with Services. If you have given your information to any third parties and they connect with Outside Analytics or our affiliates, we may use your information to ensure consistency across our Services offerings with you. We may also combine information that you provide to Outside Analytics with information that you provide to others. Outside Analytics is not responsible for information you have shared publicly.

We will ask for your consent before using information for a purpose other than those that are set out in this Privacy Policy.

Outside Analytics and its affiliates offer Services and process information in many countries around the world. It is likely that we may process your information, including personal information, on a server located outside the country in which you live.

Accessing and updating your personal information

As part of managing your account with Outside Analytics and your use of our Services, our goal is to ensure that you can view, modify, update and delete your personal information upon request, unless we have to keep your information for legitimate business or legal purposes.

We may reject requests where we cannot verify your identity, or where the request would require an impractical or disproportionate effort or risk, such as technical challenges, privacy breach concerns, accessing backups, repetitive requests, etc.

Information we share

We do not share Personal Information with companies, organizations and individuals outside of Outside Analytics unless one of the following circumstances applies:

In certain cases, we share personally identifiable information:

  • when a person has given their consent to do so (like where you are notified that the information you submit will be shared in a particular way and you then provide that information),
  • with service providers who help us provide our services (if it is necessary, but they are not permitted to disclose or to use that information for any other purpose),
  • with our partners and customers (if it is necessary to provide our products and services but they are not permitted to disclose or to use that information for any other purpose), when we believe that we are legally authorized or required to do so, or where doing so is reasonably necessary or appropriate to comply with the law or legal processes or to respond to lawful requests or legal authorities (such as a subpoena or court order), if it is necessary to defend or to protect our rights, property, or interests, and in connection with a corporate transaction (like a financing, acquisition, sale of company assets, or bankruptcy) where this information would be disclosed or transferred as one of our business assets.
  • with your consent.

We will share your information with companies, organizations or individuals outside of Outside Analytics and its affiliates when we have your consent to do so.

  • With account administrators

    If your Outside Analytics account is managed for you by an administrator who provides support for your organization, then the administrator will have access to information about your account with us and may be able to view use characteristics on your account, change, suspend, access or view your account details and usage information. Please refer to your administrator’s privacy policy or usage guidelines for more information on your privacy expectations with your administrator and organization.

  • For external processing and analytics

    We provide personal information to our affiliates or other trusted businesses or persons to process it for us, based on our instructions and in compliance with our Privacy Policy and any other appropriate confidentiality and security measures.

  • For legal reasons

    We will share personal information with companies, organizations or individuals outside of Outside Analytics if we have a good-faith belief that access, use, preservation or disclosure of the information is reasonably necessary to:

    • meet any applicable law, regulation, legal process or enforceable governmental request,
    • enforce applicable Terms of Service, including investigation of potential violations,
    • detect, prevent, or otherwise address fraud, security or technical issues, or
    • protect against harm to the rights, property or safety of Outside Analytics, our users or the public as required or permitted by law.
  • Sharing of Aggregated Information

    While we do not share personal information with companies, organizations and individuals outside of Outside Analytics without your consent, we may share information that we have aggregated to show trends, statistics on the use of our Services, marketing effectiveness, usage rates and the like. This aggregated data does not contain personally-identifiable information and we may be share such information publicly with our partners or third parties.

  • Community Forums

    We may offer public forums, blogs or other means of sharing information from the OUTLY Platform.

    The Service may provide you the opportunity to participate and post content publicly in forums, on blogs, through interactive features in the OUTLY Platform and through other communication functionality (“Community Forums”). You may choose, through such features or otherwise, to submit or post questions, comments, comments recommendations, postings, reviews likes, questions or other content (collectively, “User Forum Content”). Please note that certain information, such as your name and user profile may also be publicly displayed on the Service along with your User Forum Content. Your use of Community Forums is subject to our Terms of Service.

    Note that anything you post to a Community Forum is public — others will have access to your User Forum Content and may use it or share it with third parties. If you choose to voluntarily disclose Personal Information in your User Forum Content or use Community Forums to link to your Profile, that information will be considered public information and the protections of this Privacy Policy will not apply.

    To request removal of your personal information from our blog or community forum, contact us at support@outsideanalytics. In some cases, we may not be able to remove your Personal Information, in which case we will let you know if we are unable to do so and why.

Feedback

We collect feedback from Outside Analytics Users about their experience with other Outside Analytics Users of our Service. Please note that any feedback you provide via the Service or feedback provided about you is publicly viewable via the Service. On very rare occasions, we may remove feedback pursuant to the relevant provisions of our Terms of Service.

Email to Friends and Referral Program

Outside Analytics lets you send project postings to friends via email. Outside Analytics also offers the ability to send friends emails about providing or purchasing services through the Service. If you choose to use either feature, your friend’s email address will be used to send the requested posting and your email address will be used to copy you on the message to your friend or to send the message on your behalf. Outside Analytics stores this information for the sole purpose of sending this one-time email and tracking the success of our referral program.

Your friend may contact us at support@outsideanalytics.com to request that we remove this information from our database.

Information security

Outside Analytics takes reasonable steps to protect the confidentiality of our information and yours. We may use encryption and verification processes to help prevent unauthorized access to or unauthorized alteration, disclosure or destruction of information. Outside Analytics restricts access to personal information to our affiliates, employees, contractors and agents who need to know that information in order to process it, and who are subject to strict contractual confidentiality obligations. We periodically will review our information collection, storage and processing practices to help ensure the security of your information and prevent unauthorized access to systems and Services.

How We Respond to Do Not Track Signals

Please note that your browser setting may allow you to automatically transmit a “Do Not Track” signal to websites and online service you visit. There is no consensus among industry participants as to what “Do Not Track” means in this context. Like many websites and online services, Outside Analytics does not alter its practices when it receives a “Do Not Track” signal from a visitor’s browser. If you wish to take steps to opt-out of tracking by certain online advertisers, you can visit the Digital Advertising Alliance’s opt-out page at http://www.aboutads.info/choices. To learn more about, or to opt-out of Google’s analytic and marketing services, visit Google Analytics Terms of Use, the Google Privacy Policy, or Google Analytics Opt-out.

Compliance and cooperation with regulatory authorities

We periodically review our Privacy Policy and assess our compliance therewith. We take complaints seriously, so if we receive formal written complaints, we will contact the complainant and follow up on the matter. In the event of a suspected data breach, we will notify the relevant authorities and work with them to assess risk and resolve any issues.

International Transfer of Personal Information

Outside Analytics is a United States-based company. If you are located outside the United States and choose to provide information to us, Outside Analytics transfers Personal Information to the United States for processing. The U.S. may not have the same data protection laws as the country in which you initially provided the information. When we transfer your information to the U.S., we will protect it as described in this Privacy Policy. By visiting the Site, using the Services or providing Outside Analytics with any information (including but not limited to personal data), you fully understand and unambiguously consent to this transfer, processing, access to and storage of your information in the United States.

Amendments to our Privacy Policy

Outside Analytics may modify its Privacy Policy in its discretion and without requiring notice to you. The most current version of our policy will be posted. If you do not agree with any changes we may make, you should discontinue using our Services.

California Residents – Your California Privacy Rights

Pursuant to California Civil Code Section 1798.83, California residents who provide us with Personal Information in using the Services are entitled to request and obtain from us, one time per calendar year, information about the customer information we shared, if any, with other businesses for their own direct marketing uses. Alternatively, the law provides that a company may comply, as Outside Analytics does, by disclosing in its privacy policy that it provides consumers choice (opt-in or opt-out) regarding sharing Personal Information with third parties for those third parties’ direct marketing purposes, and information on how to exercise that choice. As stated above in this Privacy Policy, Outside Analytics provides you choice prior to sharing your personal information with third parties for their direct marketing purposes. If you do not opt-in or if you choose to opt-out at the time Outside Analytics offers that choice, Outside Analytics does not share your information with that identified third party for its direct marketing purposes.
